Complaint declined
There are a number of reasons the Commission may decline a complaint including that:
- it would be better dealt with by a tribunal or court
- it is 'frivolous, vexatious, misconceived of lacking in substance'
- it is about something that happened more than 12 months ago
- an 'exception' to the law applies
If a complaint is declined, the Commission will inform everyone involved explaining the reasons for its decision. This letter will also provide details of your right to have the complaint referred to the Anti-Discrimination List at the Victorian Civil and Administrative Tribunal (VCAT).
